Terms of Service

By accessing or using lichsouls.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Site. These Terms apply to all visitors, members, and others who access or use the Site.

We reserve the right to modify these Terms at any time. Continued use of the Site after any modification constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

You must be at least 13 years old to use this Site. This minimum age is set by Discord's Terms of Service, which governs the authentication method used to access member features. By using the Site, you represent and warrant that you meet this age requirement.

We do not knowingly collect personal information from children under 13. If we learn that a user is under 13, we will terminate their account and delete associated data promptly. If you believe a minor has registered, contact us immediately.

Access to member features requires authentication through Discord OAuth or Twitch OAuth. You are responsible for maintaining the security of your Discord/Twitch account and for all activity that occurs through your session on this Site. We are not liable for any loss resulting from unauthorized use of your account.

You agree to provide accurate information and to keep your linked account in good standing. Accounts found to be using false identity, impersonating others, or bypassing access restrictions will be terminated without notice.

You agree to use the Site only for lawful purposes and in a manner consistent with these Terms and our Community Rules. You agree not to:

• Post, transmit, or share any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy
• Impersonate any person or entity, or falsely claim an affiliation with any person, entity, or Lich Souls Gaming staff
• Harass, bully, intimidate, or stalk any other user
• Attempt to gain unauthorized access to any portion of the Site, other accounts, or systems connected to the Site
• Use automated tools (bots, scrapers, crawlers) to access or collect data from the Site without prior written permission
• Introduce viruses, malware, or any code designed to disrupt, damage, or limit the functioning of the Site or any connected systems
• Use the Site for any commercial solicitation, spam, or unsolicited promotion
• Circumvent, disable, or interfere with security features of the Site, including content encryption or access controls

The following content is strictly prohibited on the Site in any form, including direct messages, wall posts, profile media, comments, and any other user-generated submission:

• Any image, video, link, or description of child sexual abuse material (CSAM) or child exploitation material of any kind
• Non-consensual intimate imagery ("revenge porn") or any content that violates a person's reasonable expectation of privacy
• Content that constitutes, facilitates, promotes, or incites violence against any person or group
• Content that promotes, glorifies, or facilitates terrorism, mass violence, or hate groups
• Content that discriminates against or dehumanizes individuals on the basis of race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic
• Doxxing — the posting of another person's private information (address, phone number, workplace, etc.) without their consent
• Illegal activity of any kind, including but not limited to fraud, theft, drug trafficking, or distribution of controlled substances
• Copyright-infringing material posted without the rights holder's permission

Violations of this section may result in immediate account termination and, where required or appropriate, reporting to law enforcement.

Lich Souls Gaming has a zero-tolerance policy for child sexual abuse material (CSAM) or any content that sexually exploits minors. We are required by United States federal law (18 U.S.C. § 2258A) to report any apparent violation involving child exploitation to the National Center for Missing and Exploited Children (NCMEC) CyberTipline. We will also cooperate fully with law enforcement in any related investigation.

If you encounter any such content on the Site, report it immediately using the report feature available on user profiles and messages, or contact staff directly in our Discord server. Do not engage with, share, or download the content.

Direct messages on this Site are private in the sense that they are not publicly displayed. However, they are not end-to-end encrypted. Message content is encrypted at rest on our servers using AES-256-GCM (our Warden system), but Lich Souls Gaming staff retain the technical ability to decrypt and review message content when required for moderation purposes, legal compliance, or in response to a valid legal process.

By using the direct messaging feature, you acknowledge and consent to this. Do not use direct messages to share content you would not be comfortable having reviewed by staff under the circumstances described in our Privacy Policy.

You retain ownership of content you create and post on the Site (profile information, wall posts, direct messages, uploaded media). By posting content, you grant Lich Souls Gaming a non-exclusive, worldwide, royalty-free license to store, display, and transmit that content solely as necessary to operate and provide the Site's features to you and other users.

This license terminates when you delete the content or request account deletion, subject to reasonable retention periods for legal and abuse-prevention purposes as described in our Privacy Policy.

You represent and warrant that you have all rights necessary to post any content you submit, and that your content does not violate any third party's rights or these Terms.

The ability to send image attachments in direct messages requires account verification by Lich Souls Gaming staff. This restriction exists to reduce the risk of prohibited media being shared through the platform. Verification is granted at staff discretion and may be revoked at any time.

Verification does not exempt you from the prohibited content rules in Section 5. Any verified user who sends prohibited content will have their account terminated and, where applicable, reported to the relevant authorities.

The Site's design, branding, original written content, and code are the property of Lich Souls Gaming. You may not reproduce, distribute, or create derivative works from them without explicit written permission.

Game-related assets (artwork, names, game mechanics) belong to their respective rights holders — Jagex (RuneScape), Mojang/Microsoft (Minecraft), Blizzard Entertainment (Overwatch), Rare (Sea of Thieves), Wizards of the Coast (Dungeons & Dragons), and others. Lich Souls Gaming claims no ownership of these assets.

If you believe content on the Site infringes your copyright, you may submit a notice to us in our Discord server or by contacting a staff member directly. Your notice should include: (1) identification of the copyrighted work claimed to be infringed; (2) identification of the infringing material and its location on the Site; (3) your contact information; (4) a statement that you have a good-faith belief the use is unauthorized; and (5) a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

We will respond to valid DMCA notices by removing or disabling access to the claimed infringing material and, where appropriate, terminating the accounts of repeat infringers.

We reserve the right to suspend or terminate your access to the Site at any time, with or without notice, for any reason, including but not limited to violation of these Terms, violation of our Community Rules, conduct that we determine to be harmful to other users or the community, or at our sole discretion.

Upon termination, your right to access member features ceases immediately. Content you have posted may be retained as described in our Privacy Policy.

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. We do not warrant that the Site will be secure, accurate, complete, or free of viruses or other harmful components.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LICH SOULS GAMING AND ITS OPERATORS, STAFF, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM: (i) YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE; (ii) ANY CONDUCT OR CONTENT OF ANY OTHER USER ON THE SITE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR CONTENT.

You agree to defend, indemnify, and hold harmless Lich Souls Gaming and its operators, staff, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your infringement of any third party's rights.

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflicts of law principles. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts located in the United States.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
